SATYAPON & PARTNERS is one of the most active firms in Thailand involved in the enforcement of intellectual property rights, especially trademarks. We have assembled an experienced team of investigators and attorneys to work closely with various law enforcement agencies throughout Thailand to combat the infringement of our clients' intellectual property rights.

In 1998, our enforcement team, accompanied by the police, was responsible for the arrests of 235 infringers and the seizure of over 30,000 counterfeit items. All arrests resulted in successful criminal prosecutions by Public Prosecutors.

In 1999, our investigations led to the arrests of 402 infringers and seizure of over 22,000 counterfeit goods. Again, all cases were successfully prosecuted.

In 2000, our investigations led to the arrests of 407 infringers and the seizure of some 345,000 counterfeit items.

In 2001, our investigations led to the arrests of 431 infringers and the seizure of some 150,000 counterfeit items.

In 2002, our investigations led to the arrests of 410 infringers and the seizure of some 103,000 counterfeit items.

In 2003, our investigations led to the arrests of 423 infringers and the seizure of some 138,732 counterfeit items.

In 2004, our investigations led to the arrests of 550 infringers and the seizure of some 158,377 counterfeit items.

Most of the above cases involve trademark infringement. The penalties for trademark infringement include a fine of up to 400,000 Thai baht and a term of imprisonment of up to 4 years, or both. Civil remedies, including injunctive relief, may also be available.

Some of these cases involved design patent infringement. The penalties for patent infringement include a fine of up to 400,000 Thai baht and a term of imprisonment of up to 2 years, or both. Civil remedies, including injunctive relief and damages, retroactive to the publication date, may also be available.

Other cases involve copyright infringement. The penalties for copyright infringement include a fine of up to 800,000 Thai baht and a term of imprisonment from 6 months to 4 years, or both. Civil remedies, including injunctive relief and damages, may also be available.
